Judge In Brock Turner Sexual Assault Case Recalled By Voters

Predating the #MeToo movement of women speaking out publicly against sexual harassment and abuse, the outcome of the Turner case became a symbol of how the USA justice system fails to take sex crimes seriously enough.

Mr Turner was released after serving just three months of his six-month term and has since appealed against his conviction. He did not mention the impact of the assault on the victim, known publicly only as Emily Doe, who described her suffering in a more than 7,000-word statement that went viral soon after it was published by BuzzFeed. At the time of the attack, Turner was a freshman on Stanford's swim team.

Many complained Mr Persky showed too much deference to Mr Turner, a white Stanford scholarship athlete whose parents could afford a private attorney. "That is not a thing", Michele Dauber, a Stanford law professor who organized the recall petition, wrote in a Twitter message on Wednesday. Now, they fear, other judges in elected positions will be reticent to issue unpopular but lawful rulings. "The more places in which that signal can be sent, the better women will do".

Recalling a judge is not easy, a reality reflected by its rarity in the electoral process.

'I expected some negative reaction, ' Persky said. Persky said he was unaware of complaints. "The problem with this recall is, it will pressure judges to follow the rule of public opinion as opposed to the rule of law", he said. Critics said the six-month sentence was too lenient. But the judge said the publicity of Turner's arrest and trial and his loss of a swimming scholarship also factored into the sentence.

For his part, Turner has to register as a sex offender for life. KABC's sister station KGO-TV requested access for comment as the results came in, but no commitment were given.

A UC Berkeley School of Law graduate, Persky was an associate with Morrison & Foerster before joining the Santa Clara County District Attorney's office in 1997. Hendrickson has 10 days after the election is certified on July 5 to take the oath of office. The unseated judge would be removed at that point.

"The vote today - if the numbers hold - is a vote against impunity for high-status offenders of domestic violence and sexual violence", Dauber said, according to the San Jose Mercury News.

But others argue that Persky's recall was unique, coming in the midst of pent-up anger among some over President's Trump's treatment of women before he was elected, longstanding concerns about campus sexual assault, and the #MeToo movement.

It's a historical moment when women across all sectors of society are standing up saying enough is enough. "But we found that a lot of the voters were educated". They understand that the independence of our judiciary is one of the cornerstones of our democracy. "You know, it doesn't have to be a judge". On nights when you feel alone, we are with you. "The public doesn't understand what's going on in the courts", said Edwards.
