Charges Filed Against Asheville Cop Who Beat, Tased Man for Jaywalking

In a statement, police later apologized to Rush for not providing "fair and respectful service" and characterized Hickman's actions as "unacceptable and contrary" to the department's vision.

Body camera video showing a black man being Tasered and beaten during a confrontation with two white police officers who accused him of jaywalking has sent shock waves through the western North Carolina city of Asheville, forcing one of the officers to resign, prompting a federal investigation and leading the city's police chief to volunteer to step down. A phone listing for Hickman, who resigned in January, had a full inbox that wouldn't take messages.

The city of Asheville has filed a petition requesting that the Police Department release additional body camera footage from the night of Rush's arrest to provide the public with a "complete picture of the incident".

At a certain point Rush endeavors to run, and Hickman says "You recognize what's interesting is you will get f - ed up no-nonsense".

The announcement comes after the North Carolina State Bureau of Investigation, which had declined to open its own investigation into the matter, said the FBI had launched a criminal investigation into the case.

In particular, it was the investigation into Hickman, who's white, that was brought up the most.

Despite the policy, Hickman was shown on video published last week by The Citizen-Times subduing Johnnie Jermaine Rush, then punching and shocking him with a stun gun.

Although the beating occurred in August, the public was not informed of the incident until a source provided the body camera footage to the Citizen Times this week.

Rush admitted running when he heard Hickman.

The documents show a supervisor responded to the use of force against Rush, but did not send the information to superiors immediately.

The video showed Hickman and a trainee stopped Rush for jaywalking.

Jackson wrote that as soon as Asheville Police Chief Tammy Hooper saw the video on the night it was taken, she ordered Hickman to "to turn in his badge and gun". Assault charges against Rush were dropped soon after he filed an excessive force complaint.

Weeks later, after reviewing almost 60 hours of Hickman's body camera footage from numerous encounters, the department identified four other instances of rude behavior toward members of the public. The warrant said Rush lost consciousness when Hickman placed his arm on his throat and applied pressure.

Following an SBI investigation, Hickman resigned, and will probably be charged later this year.

City Councilwoman Sheneika Smith told the New York Times that she recognized Rush from her work with the nonprofit Green Opportunities, which provides job training.

Hickman was charged with communicating threats due to that phrase, according to a warrant obtained by the newspaper.

During the meeting, Hooper repeated an apology to the community she first publicly issued on March 1, saying, "I am happy to resign if that will solve the problem". "It's hard enough that we can't just throw a piece of technology at it and expect to substantially change police supervision", said Seth Stoughton, who teaches law at the University of SC.
