US Upholds Import Tariff on Bombardier

The United States on Wednesday finalized steep duties against Bombardier C Series commercial jets, a move that may further inflame tensions over ongoing negotiations of the North American Free Trade Agreement (NAFTA).

Boeing, which launched the petition over the sale of 75 CSeries aircraft to Delta Air Lines, says the decision validates its complaint. Boeing said Bombardier hurt its chances of selling its 737 airplane in the USA, which Bombardier denies.

"These investigations have already established beyond question that Bombardier has taken billions of dollars in illegal government subsidies to prop up its C Series program". Bombardier and Boeing argued their cases Monday before the ITC, an independent, quasi-judicial US agency.

"This decision is based on a full and unbiased review of the facts in an open and transparent process", Commerce Secretary Wilbur Ross said in a statement.

"Tariffs on the scale proposed by the US Commerce Department in the world's largest airline market, threaten to undermine the long-term economics of Bombardier's presence in Northern Ireland".

The partnership with Airbus means there is "no chance Boeing will be harmed by imports", said Mike Nadolski, vice president of public affairs at Bombardier.

"Boeing's assertion that future imports from Canada threaten to cause material injury is necessarily based on just the type of "speculation and conjecture" that is prohibited under both US and global law", MacNaughton told the panel.

In the progress of the trade dispute, Bombardier agreed to sell a majority interest in the CSeries program to Airbus, intensifying the completion in that product category for Boeing.

"A single large order, like Bombardier's sale to Delta, takes years of demand out of the market".

With the new judgement passed on Wednesday, the US made a decision to find in favor of Boeing.

Boeing says that should not negate the duties because Airbus and Bombardier would import fuselages and wings and merely be assembling in the United States.

USA and Mexican trade officials will meet next month in Canada to continue NAFTA talks.

It includes a 79.82% tariff to offset a Commerce Department ruling that Bombardier engaged in price dumping, meaning it sold the CS100s to Delta below its fair market value by that amount.

Bombardier criticised the near-300% duties, saying its plan of partnering with the European company Airbus to launch the CSeries assembly from a production line in Mobile, Alabama, would make it an American company.

No planes have yet entered the United States.
