Trump admin amends travel ban date to keep legal battle alive

The latest ruling against the Trump administration's ban on travel from six Muslim nations is a particularly sharp blow to the president not because it is more sweeping than previous legal decisions - the 9th Circuit's decision is actually somewhat narrower than the district court opinion in the case - but because it reaches the same result for different reasons.

The White House has asked the Supreme Court to allow the ban to take effect immediately. The court is now considering an emergency request from the administration seeking to put its travel ban into effect while litigation continues.

President Donald Trump paid a brief visit Thursday to the Supreme Court, where he had a front-row seat but no formal role in a courtroom ceremony honoring his high court pick and the newest justice, Neil Gorsuch.

The president's travel ban, first issued in January, and a revised order from March have been in legal limbo after federal judges put them on hold and appeals courts have upheld those rulings.

The ruling also states: "A reasonable, objective observer - enlightened by the specific historical context, contemporaneous public statements and specific sequence of events leading to its issuance - would conclude that the executive order was issued with a goal to disfavor a particular religion".

The policy has caused some travel industry organizations, particularly the Global Business Travel Association (GBTA), to warn that it could harm inbound travel to the United States.

The 9th Circuit, which heard arguments in Seattle last month in Hawaii's challenge to the ban, found no need to analyze Trump's campaign statements.

Federal judges in Maryland and Hawaii blocked Trump's 90-day ban on travelers from Libya, Iran, Somalia, Sudan, Syria, and Yemen.

Judges Michael Hawkins, Ronald Gould and Richard Paez - all appointed by President Bill Clinton - said the travel ban violated immigration law by discriminating against people based on their nationality when it comes to issuing visas and by failing to demonstrate that their entry would hurt American interests. But the case also underlies a disturbing truth: Even if opponents succeed in stopping President Donald Trump from implementing this particular version of the Muslim ban, the fight over the issue is far from over.

ASTA President and CEO Zane Kerby said that the organization would continue to "monitor the situation closely with an eye toward any impact on our members' businesses, and will do everything possible to ensure member are kept up to date, able to serve their clients and prepare them for any disruptions that might occur". The new version, created to better withstand legal scrutiny, named six countries instead of seven - dropping Iraq - and spelled out more of a national security rationale.
